Your Relationship With Us
Welcome to Dayout (the “Platform”), which is provided by Dayout LLC (“Dayout”). You are reading the terms and conditions of service (the “Terms”), which govern the relationship and serve as an agreement between you and us and set forth the terms and conditions by which you may access and use the Platform. For purposes of these Terms, “you” and “your” mean you as the user of the Services; “we” and “us” mean Dayout LLC. Our Services are provided for private use. The Terms form a legally binding agreement between you and us. Please take the time to read them carefully. By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you are also not allowed to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Dayout. Dayout is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for. The Dayout app processes personal data that you have provided to us. We do not store or sell any data that is submitted to the platform. We partner with Stripe for identity verification and purchases. As such, information required for these purposes is shared between Dayout and Stripe to facilitate secure and efficient transactions and compliance with applicable laws.

Eligibility
You may not use the Services, provide any personal information to Dayout, or otherwise submit personal information through the Services (including, for example, a name, address, telephone number, or email address) if you are under the Minimum Age. The Minimum Age is (i) thirteen (13) or(ii) sixteen (16) for users in the European Union or the United Kingdom. You may only use the Services if you can form a binding contract with Dayout and are not legally prohibited from using the Services.
Service Changes and Limitations
The Services change frequently, and their form and functionality may change without prior notice to you. Dayout retains the right to create limits on and related to use of the Services in its sole discretion at any time with or without notice. Dayout may also impose limits on certain Services or aspects of those Services or restrict your access to parts or all of the Services without notice or liability. Dayout may change, suspend, or discontinue any or all of the Services at any time, including the availability of any product, feature, database, or Content. Dayout may also terminate or suspend Accounts at any time.
Content & User Content
For purposes of this Agreement, the term "Content" means a creative expression and includes, without limitation, video, images, articles, reviews, and text. Users retain ownership and/or other applicable rights of User Content, and Dayout retains ownership of User Content. You retain ownership of any intellectual property you post to Dayout. When you provide User Content to Dayout through the Services, you grant Dayout a non-exclusive, worldwide, royalty-free, sub-licensable, transferable right and license to use, host, store, cache, reproduce, publish, display, perform, distribute, transmit, modify, adapt, and create derivative works of such User Content. The rights you grant in this license are for the limited purposes of allowing Dayout to operate the Services in accordance with their functionality, improve and promote the Services, and develop new Services. Note also that this license to your User Content continues even if you stop using the Services, primarily because of the social nature of Content shared through Dayout Services - when you post something publicly, others may choose to comment on it, making your User Content part of a social conversation that can’t later be erased without retroactively censoring the speech of others.
Prohibition on Sharing or Misusing Premium Content
Users who purchase, access, or otherwise obtain premium content or paid features through the Platform ("Premium Content") are granted a limited, non-transferable, non-exclusive license to use such content solely for their personal and private use. Premium Content may not be shared, distributed, reproduced, resold, or otherwise used for commercial or unauthorized purposes without prior written consent from Dayout or the content owner.
Any attempt to share, replicate, or provide unauthorized access to Premium Content, whether via screenshots, downloads, or other methods, is strictly prohibited and may result in account termination, legal action, or other remedies as deemed necessary by Dayout.
Users are encouraged to report any unauthorized sharing or misuse of Premium Content through the reporting system available in the app.
Termination and Deletion
On termination of your Account, or upon your deletion of particular pieces of User Content from the Services, Dayout shall make reasonable efforts to make such User Content inaccessible and cease use of it and, if required by the applicable Privacy Policy, delete your Account data and/or User Content unless permitted or required to keep this data in accordance with law; however, you acknowledge and agree that: deleted User Content may persist in caches or backups for a reasonable period of time and copies of or references to the User Content will not be entirely removed.
Digital Millennium Copyright Act (DMCA) Copyright Policy
As of now, any content that is submitted to the platform cannot be subject to copyright. Due to this being a public platform where anyone can post anything that they like, we do not want to limit the users in any type of way. By reading the Terms, you agree to this and cannot take any legal action until further notice. This is subject to change in the future as we get updated DMCA guidelines. If you see your content on the platform and want it to be taken down, please use the report system, and we will take action from there.

As a global platform for blocking time, sharing plans, and inspiring activities, Dayout is deeply committed to supporting and protecting freedom of speech. At the same time, we draw lines around a few narrowly defined but deeply important categories of content and behavior that jeopardize our users, threaten our infrastructure, and damage our community.

Moderation Policy
Our team uses a human review system to detect and remove policy violating content. Policy violations may be brought to our attention via user reports. Content can be reported directly to Dayout via the report button located throughout the app. If any of these guidelines are violated, posts and accounts can be taken down without any notice. These guidelines shouldn’t have to be explained in any detail; as well, when you see the words, you are expected to know what these mean. We have a zero-tolerance policy.
